Commercial Damages Practice
For more than 27 years, Barry Bell has focused primarily on the analysis and quantification of damages in commercial litigation matters. He is experienced in analyzing complex matters; identifying relevant issues, information and approaches; and cogently communicating, via expert reports and testimony, the resulting opinions to interested parties.
Mr. Bell has provided expert testimony in matters before state and federal courts as well as in arbitration. He has provided expert opinions in matters involving allegations of breach of contract; breach of fiduciary duty; fraud; trade secret misappropriation and copyright, patent and trademark infringement, among others.
Mr. Bell has also led engagements in analyzing damages related to business interruption, dealer termination, product liability, fraudulent conveyances, and professional liability, among others. He has analyzed and/or presented claims for restitution and for damages under reliance, expectancy (lost profits), reasonable royalty, unjust enrichment, and statutory damages constructs.

Lance Gunderson has over 27 years of experience in financial and litigation consulting. His area of expertise is intellectual property damages analysis and calculations including lost profit calculations, reasonable royalty determinations, and other intellectual property quantitative analysis such as valuations. Mr. Gunderson has provided financial analysis and valuation assessments on patent, trademark, trade secret, and copyright issues. Mr. Gunderson has testified numerous times in patent infringement disputes, trademark disputes, copyright disputes and false advertising disputes in both state and federal court. He has assisted in license negotiations and has been involved in technology transfer from Texas A&M University to the private sector. Mr. Gunderson also has testified on damages in breach of contract disputes.
During his career, Mr. Gunderson has had significant involvement with company and law firm personnel in the identification of relevant markets, financial and economic information, and the development of damages scenarios. His industry experience includes the automotive, airline, chemical, computer, consumer products, electronics, healthcare, retail, software, semiconductor, and telecommunications sectors.
Mr. Gunderson is a certified valuation analyst and a member of the National Association of Certified Valuation Analysts. Mr. Gunderson is also a member of the Licensing Executives Society, an organization of more than 5,000 members including corporate executives and professionals involved in the licensing and valuation of patents, trademarks and other intellectual property.

W. Barefoot Bankhead has been a Texas licensed CPA for 40 years. He has served in the banking industry for more than 35 years as an auditor, regulator, senior executive, board member, and consultant. From November 2007 until retirement in June 2017, Mr. Bankhead was a partner in Deloitte Financial Advisory Services LLP (“Deloitte FAS”) and served as the National Banking & Securities Industry Leader for Deloitte FAS from 2008 to 2010. He also served as the fraud audit specialist for some of Deloitte and Touche’s largest financial industry audit clients.

Mark Rambin has been a licensed CPA for over 30 years and has focused his practice on financial investigation and forensic accounting since early in his career.
